Composition, gradation, color, moisture content, density, contaminant levels, and other physical characteristics may vary from batch to batch and from any sample, photograph, or description provided.
Except as expressly stated in a signed written agreement, all materials are sold "AS IS" and "WITH ALL FAULTS," and the Company makes no warranties of any kind, express or implied, including without limitation any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. The customer is solely responsible for determining whether any material is suitable for the customer's intended use; for independently testing, inspecting, and verifying material before use; and for ensuring that the selected material complies with all applicable engineering specifications, building codes, environmental regulations, and permit requirements. The Company is not responsible for any use of material that does not conform to the customer's project requirements.
This Site and our staff do not provide engineering, geotechnical, structural, construction, environmental, or legal advice. The customer is responsible for locating and marking all underground utilities and obstructions prior to delivery and for obtaining any permits required for delivery or material placement. The customer assumes all risk associated with directing our vehicles or equipment onto private property.
To the maximum extent permitted by law, in no event shall American Crushing & Aggregates LLC, its members, managers, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, revenue, business, data, or goodwill, arising out of or relating to this Site, our products or services, or the use or inability to use either, whether based in contract, tort (including negligence), strict liability, or any other theory, even if advised of the possibility of such damages.
To the maximum extent permitted by law, the total aggregate liability of the Company arising out of or relating to any product, service, or transaction shall not exceed the amount actually paid by the customer to the Company for the specific product or service giving rise to the claim.
